Congress specifically defined each of the terms “perform” and “publicly” in Section 101 of the Act as follows:
To “perform” a work means to recite, render, play, dance or act it….”
To perform … a work “publicly”
February 14, 2021 - Exemptions
Generally speaking, the exemptions called for under Section 110 are very limited in scope. Most musical performances you'll find in public spaces are not exempt unless they thoroughly meet one or more of these Section 110 exemptions. The Law provides exemptions in eleven specific contexts.
